The act as amended requires reports to the health officer, and in its penal clause declares that every physician and person acting as a physician, who shall refuse or neglect to immediately give such notice shall forfeit for each such offense a sum not less than $10 nor more than $50. "It is plain," says the attorney-general, "from the wording of the above section of the act, that it applies to either physicians as such, or persons acting as physicians." The question whether a "Christian Science" healer is thus included is taken up, and he finds that the term "physician" is only applicable to one lawfully certified
