In letters to the leadership of the Centers for Medicare & Medicaid Services and the Department of Health and Human Services' Office of Inspector General, Stark asked if Accretive Health is violating federal laws, including the Emergency Medical Treatment and Active Labor Act and the Health Insurance Portability and Accountability Act. The Minnesota Attorney General is suing Accretive Health, claiming that the company, in part, imposed quotas on hospital personnel to collect money for treatment, sometimes before treatment was provided, even in the emergency department.
